September 16, 1995 Dear Mark: Only days following the FDA announcement that MSG is safe for almost everyone, and causes only mild and temporary reactions in just a few people, trial begins Monday, September 18 in Superior Court, Burbank California where David Livingston will tell a jury that he almost died after eating MSG. Plaintiff in the $100,000,000 suit is David Livingston, age 42. Defendants are Marie Callender's restaurants. Livingston knew he was sensitive to MSG. Upon ordering food at the restaurant, he carefully questioned the server about MSG. He was assured that the restaurant did not use MSG in the food that he ordered. Upon leaving the restaurant, Livingston did not feel well and went to his physician's nearby office, were he went into respiratory arrest. He was revived and transferred to the local hospital where Livingston went into cardiac arrest. It was determined that the food ingested by Livingston contained MSG. Adrienne and I both feel that Mr. Livingston's experience is just one more demonstration that people are suffering life-threatening responses from MSG, and that FDA's announcement that only "significant" amounts of MSG will cause mild reactions in small numbers of people is ridiculous. You will remember that on August 29, 1995 the Truth in Labeling Campaign and 29 individuals filed suit against the FDA in Federal Court asking for full disclosure of all MSG in all processed foods.
